1Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Therapeva, a brand of The Nelson M Group LLC ("Therapeva," "we," "us"). They govern your use of therapeva.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Do not use the Services if you disagree with any of this.

2What Therapeva is, and is not

Therapeva is an information service. We publish general, plain-language data about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we do not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any any other business partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Therapeva, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

3Eligibility

You need to be 18 or older, based in the United States, and able to form a binding contract before using the Services, and the information you submit must be your own or that of a person who authorized you to submit it.

4Your information and accuracy

Accurate, current information is required, and you agree to update it as needed. Do not give us a mobile number unless it is yours or you are authorized to use it. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

5Communications and text-message consent

If you opt in, you agree that we may contact you by email and, if you check the applicable boxes, by automated text messages as outlined in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. 6Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-551-0280.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

7Acceptable use

The next are prohibited: (a) submitting false or misleading information, or information about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

8Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are run by third parties. We will not endorse any product, plan, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with any doctor or study team is between you and them.

9Intellectual property

The Services, for example the Therapeva name, logo, text, graphics, and design, are held by us or our licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial viewing and use of the Services. Photos on the Site carry their own free-use licenses.

10Disclaimers

The services and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Therapeva does not offer financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

Where the law permits, Therapeva and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

12Indemnification

You agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your provision of a phone number or other information that you were not authorized to offer.

13Disputes, governing law, and arbitration

Informal resolution first. Before taking a dispute additional, email us at [email protected] giving us 30 days to try to work it out.

Binding arbitration. Except where a matter belongs in small claims or involves injunctive relief for intellectual-property misuse, you and Therapeva or The Nelson M Group LLC agree that any dispute arising out of or relating to these Terms or the Services will be decided by final, binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in your county of residence or by video or phone, as you choose. The arbitrator may award the same individual relief as a court, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. Both you and Therapeva agree, as far as the law permits, to pursue claims individually only, never as a plaintiff or member of a class, collective, or representative action.

Opt-out. To opt out of arbitration within 30 days of first accepting these Terms, email [email protected] and include "Arbitration Opt-Out" as the subject, along with your name and mobile number.

Governing law. We interpret these Terms under the Federal Arbitration Act and the laws of the state where The Nelson M Group LLC has its principal place of business, ignoring conflict-of-law rules. The state and federal courts located there have exclusive jurisdiction, governed by the arbitration clause.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. At our discretion we can suspend or terminate access, including for violations of these Terms. Provisions that are meant to outlast termination (disclaimers, limitation of liability, indemnification, and disputes among them) will do so.

15Changes

Updates to these Terms will be posted with a new "Last updated" date. Using the Services after the effective date means accepting the updated Terms. If a change is material, we will notify you as needed by law.

16General

These Terms, together with the Privacy Policy and SMS Terms, are the entire agreement between you and us on this subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, and we may assign them in connection with a merger or sale of the business.
